Welcome to Orb Merge! By downloading or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing and using Orb Merge, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and FireCode Studio ("we," "us," or "our").

2. Description of Service

Orb Merge is a mobile puzzle game that allows users to play a grid-based merging game. The App includes:

  • Game levels with varying difficulty
  • Leaderboards and achievement systems
  • In-app purchases for virtual goods
  • Social features including friend comparisons
  • Google Play Games integration

3. User Account

To access certain features, you may sign in using Google Play Games or create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. In-App Purchases

The App may include virtual goods and currency that can be purchased with real money:

  • All purchases are final and non-refundable unless required by law
  • Virtual goods have no real-world value and cannot be exchanged for cash
  • We reserve the right to modify or discontinue virtual goods at any time
  • Purchases are tied to your account and are not transferable

5. Acceptable Use

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Modify, adapt, translate, or reverse engineer the App
  • Remove any copyright or proprietary notices
  • Use bots, cheats, or unauthorized software
  • Attempt to gain unauthorized access to our servers
  • Interfere with the normal operation of the App
  • Harass, abuse, or harm other users
  • Impersonate any person or entity

6. Intellectual Property

All content, design, graphics, and software in the App are owned by FireCode Studio and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not copy, reproduce, distribute, or create derivative works based on the App without our express written permission.

7. User-Generated Content

You may submit content such as comments or feedback. By submitting content, you grant us a perpetual, royalty-free license to use, reproduce, modify, and distribute your content in connection with our services.

You represent that you own or have the rights to any content you submit.

8. Third-Party Services

The App may include links to or integrations with third-party services, including Google Play and advertising networks. We are not responsible for the content, privacy practices, or terms of these third-party services.

9. Termination

We may suspend or terminate your access to the App at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse or harassment of other users
  • Technical issues or security concerns

You may also stop using the App at any time by uninstalling it from your device.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the App will be uninterrupted, error-free, or completely secure. We are not responsible for any loss of data or damage to your device.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRECODE STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless FireCode Studio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FireCode Studio operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of the applicable jurisdiction. You agree to waive any right to participate in a class action lawsuit.
